Accused no.13 in Crime No.92/2023 registered by Siddapura Police Station, Bengaluru City, for the offences punishable under Sections 465, 468, 471 read with 149 IPC, is before this Court under Section 438 Cr.PC seeking anticipatory bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.92/2023 was registered by Siddapura Police Station, Bengaluru, initially for the offences punishable under Sections 418, 409, 420, 34 IPC against the officers of SBI Bank and others. During the course of investigation, some of the accused were arrested and in their remand application, petitioner is arrayed as accused no.13. Apprehending arrest in the case, he had filed Crl. Misc. No.581/2025 before the jurisdictional Sessions Court which was rejected on 03.03.3025. Therefore, he is before this Court. 4. First information was submitted by Smt. Malathi Vaidyanatha alleging that huge amount which was in the bank account of deceased Smt. Shakunthala Venkatappa Krishnappa in State Bank of India, Basavanagudi Branch, Bengaluru, who - 3 - NC: 2025:KHC:16311 CRL.P No. 4597 of 2025 had died on 21.08.2019, was illegally transferred to State Bank of India, Manale Branch, Thiruvallur District, Chennai, and thereafter, the said amount was transferred to various accounts on the basis of concocted documents produced by the accused persons. 5. Investigation conducted by the prosecution till date would reveal that total amount of Rs.7,43,35,945/- was transferred from the account of late Smt. Shakunthala Venkatappa Krishnappa to various bank accounts, and so far as the petitioner is concerned, a sum of Rs.2 Crores was transferred to his HDFC bank account bearing No.50100199845787. Petitioner has not cooperated with the police ever since the year 2023 and for the last about two years, he has successfully evaded the investigating agency. 6. Petitioner who has received a huge amount of Rs.2 Crores in his bank account, is required to explain the same to the Investigation Officers and because of the petitioner's non- cooperation investigation is not completed. It appears that from the bank account of the petitioner, the amount was further transferred to some other bank accounts, and therefore, - 4 - NC: 2025:KHC:16311 CRL.P No. 4597 of 2025 involvement of the other accused persons also cannot be ruled out in the present case. Petitioner hails from Kerala State and in event of he being granted bail, it would be difficult to secure his presence in future. Considering the material on record, I am of the opinion, custodial interrogation of the petitioner may be required in the present case. The alleged offences are punishable with imprisonment for life. Petitioner has been evading the process of law for the last more than two years and his conduct disentitles him of any discretionary relief from this Court. Accordingly, petition is dismissed.
