1. The applicant has preferred this application under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023, for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No.163/2025, registered at Police Station – Basantpur, Rajnandgaon (C.G.) for the alleged commission of offence punishable under Sections 78, 79 of BNS, 2023 and Section 12 of POCSO Act.

2 complainant inter alia on the allegation that the minor girl child of complainant has informed him through phone that at 9:45 PM on 20.04.2025, she was walking with her friend and thereafter on 10:15 PM the present applicant was blowing whistle on daughter of complainant and making signs in order to molest her. Thus the instant crime was registered against the applicant.

Learned counsel for the applicant submits that the applicant has been falsely implicated in this case. He further submits that on the night of 20.04.2025, the applicant and his wife were coming from Judges colony via Neelgiri park by walking and suddenly the complainant along with other came and started assaulting the applicant and thereafter they also intentionally insulted and outraged the modesty of the wife of applicant by touching her hand and using abusive and filthy language. On which, applicant sustained injuries and the applicant and his wife reported the matter instantly before the police Station on the same night. Thereafter, incident was reported to police station by the applicant thus purely after though the complainant using her minor daughter has lodged the FIR on 21.04.2025, saying that the applicant has outraged the modesty of his minor daughter by blowing whistle. Therefore, he prays for grant of anticipatory bail to the present applicant.
4. On the other hand, learned State counsel opposes the submission made by the learned counsel for the applicant and submits that the notice has been served to the victim and
3 service report still awaited therefore, applicant is not entitled for grant of anticipatory bail.
5. I have heard learned counsel for the parties and perused the case diary.

Considering the nature and gravity of the offence and material available on record in the case diary and also looking to the conduct and allegation levelled against the present applicant, which is of serious nature i.e. molesting a minor girl, I am not inclined to grant anticipatory bail to the applicant.

Accordingly, the anticipatory bail application of the applicant– Sanjeev Verma filed under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved in Crime No.163/2025, registered at Police Station – Basantpur, Rajnandgaon (C.G.) for the alleged commission of offence punishable under Sections 78, 79 of BNS, 2023 and Section 12 of POCSO Act is rejected.
