JUSTICE INDERJEET SINGH HON'BLE MR. JUSTICE ANAND SHARMA Order 27/05/2025 This writ petition has been filed by the petitioners with the following prayer: "It is therefore, humbly prayed that your lordships may graciously be pleaded to accept and allowed this petition and further by appropriate writ order or direction in the nature thereof respondent be directed to construct the (2 of 2) [CW-323/2023] new building of CHC Gudakatla at Gudakatla only for that it was sanctioned vide office order dated 26.11.2021 and not to shift it at Muhi as per gift deed. Any other appropriate order or direction found just and proper in favour of the Petitioner’s or public at large may kindly be issued." We have perused the writ petition as well as the reply submitted on behalf of respondents. By way of this writ petition, the petitioners have challenged the construction of Community Health Centre at Gudakatla Village Panchayat Muhi. The respondents have filed reply to the writ petition wherein para No.6 of the reply, they have stated that this land is just 200 meters away from the Gudakatla revenue area. They have also submitted an additional affidavit stating that, according to the report dated 20.12.2024, the construction of the Community Health Centre is nearly complete and the second floor has already been constructed and furnishing work is currently in progress. Considering the facts and circumstances of the present case and also considering the fact that the newly constructed Community Health Centre is located only 200 meters away from the petitioners' village, therefore, in our considered view, no case is made out for grant of any relief. Hence, this writ petition (PIL) is dismissed. (ANAND SHARMA),J (INDERJEET SINGH),J NEERU/114
