JUSTICE AHANTHEM BIMOL SINGH 04.09.2025 [1] Heard Mr. Th. Khagemba, learned counsel appearing for the petitioners and Mr. Th. Vashum, learned GA appearing for the respondents. [2] At the outset, the learned counsel appearing for the petitioners submitted that for redressing their grievances raised in this writ petition, the petitioners have earlier approach the competent authority of the State Government by filing a representation dated 04.10.2024 and that the said representation is still pending for consideration and disposal by the authorities. [3] Mr. Th. Khagemba, learned counsel submitted that the petitioners will be satisfied for the time being if the present writ petition is disposed of by directing the Commissioner (Power), Government of Manipur to consider KABOR AMBAM SAPAN A CHANU Digitally signed by KABORAMBAM SAPANA CHANU Date: 2025.09.08 16:40:22 +05'30' 2 the said representation submitted by the petitioners on its own merit and strictly in terms of the applicable rules and also by taking into consideration the recommendation made by the Administrative Officer (Power), Government of Manipur, under its letter dated 25.01.2024 (at Annexure A/23) and to dispose of the same by issuing a speaking order within a stipulated period. [4] Mr. Th. Vashum, learned GA appearing for the respondents fairly submitted that as the prayer made on behalf of the petitioners is confined to the consideration and disposal of the representation submitted by them, he has no objection in disposing of the writ petition as prayed for on behalf of the petitioners. [5] Taking into consideration, the submission advanced by the learned counsel appearing for the parties and on perusal of the record, this Court is of the considered view that it will be in the interests of justice to issue the following directions:- (1) The Commissioner (Power), Government of Manipur is hereby directed to consider the representation dated 04.10.2024 submitted 3 by the petitioners on its own merit and strictly in terms of the applicable rules and to dispose of the same by issuing an appropriate order. (2) It is made clear that at the time of considering the said representation, the Commissioner (Power) should take into consideration the recommendation/proposal made by the Administrative Officer (Power), Government of Manipur under its letter dated 25.01.2024 addressed to the Commissioner (Power), Government of Manipur and to decide the issues in terms of the applicable rules. (3) The whole exercise should be completed within a period of 3 months from the date of receipt of a certified copy of this order.
