Present petition is stated to be filed against the impugned order dated 10.02.2023 (Annexure A1) passed by the learned Upper Sessions Judge/ 2nd (POCSO) Fast Track Special Court, Raipur CG with the following reliefs: Crmp 1180 of 2023 2 i. To Set-aside impugned order dated 10.02.2023 (Annexure A-1) passed by the learned Upper Sessions Judge/Second (POCSO) Fast Track Special Court, Raipur Chhattisgarh, in the interest of justice. ii. To convict the respondents/accused for the offence punishable under Section 3, 4, 6, 7 of the Protection of Children from Sexual Offences Act, 2012 and Section 376, 452, 506-B, 324, and 294 of the IPC, in the interest of justice. iii.Any other relief which this Court may deem fit in the facts and circumstances of the case. 2. On a query being made to learned counsel for the petitioner as to whether dismissal of complaint of appellant under Section 203 of the CrPC, can be said to be order of acquittal, he could not furnish satisfactory reply to this Court, and prays for withdrawal of this petition with liberty to take recourse to law. 3. In view of above, present petition stands dismissed as withdrawn with liberty to the petitioner to take recourse to law before the appropriate forum.
