Saikia,J) Heard Mr. B.K. Mahajan, learned counsel appearing for the applicants. Also heard Ms. A. Begum, the Addl. P.P. for the State of Assam. This application has been filed under section 430(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 praying for suspension of sentence and for releasing the applicants on bail. The applicants were convicted by the learned Sessions Judge, South Salmara-Mankachar in Sessions Case No. 18/2021 and they were sentence to undergo rigorous imprisonment for life and to pay a fine of Rs. 10,000/- each, in default to undergo further rigorous imprisonment for 6 months each under section 302 IPC and further sentencing to undergo rigorous imprisonment for life for 5 years. The informant Roushanara Begum (PW-1) lodged the FIR before the Police alleging that Ichan Goni had attacked her husband with doa and sharp weapon, her husband sustained injuries on his head and left hand. Thereafter, he allegedly injured her son for which, the son expired subsequently. In the FIR, 17(seventeen) persons were named as perpetrators of the said FIR. After the investigation, the Police filed the charge-sheet against Page No.# 4/4 Ichan Goni only. In the charge-sheet, it is stated that at the time of investigation, no materials were collected against the other people. During the trial, Ichan Goni had expired thereafter, on the basis of the evidence on record and by exercising the power under section 319 of the Criminal Procedure Code, the trial court convicted the present applicants and sentence and convicted accordingly. We have considered the submission made by both side. We have also gone through the impugned judgment. This Court hereby directs that the sentences imposed upon the applicants by the learned Sessions Judge, South Salmara-Mankachar in Sessions Case No. 18/2021 shall remain suspended till the disposal of the connected appeal. The applicants namely, i) Asur Uddin @ Asuruddin SK @ Ahmod Hussain, ii) Uzir Mohammad, iii) Norzul Islam, iv) Ofiqul @ Rofiqul Hoque @ Rofiqul SK, v) Umar Faruk @ Umor Faruk Akond, vi) Afai Khatun @ Afiya Khatun, vii) Rofiqul Islam @ Rofiqul Hoque, viii) Osul Uddin @ Rusul @ Rasul Uddin, ix) Samrat Akondo @ Samrat Akond, x) Kamal SK @ Kamal Akond, xi) Rana Akond @ Rana Miah and xii) Akkas Ali shall be released on bail of Rs. 25,000/- (Rupees Twenty Five Thousand) each with surety of like amount to the satisfaction of the learned Sessions Judge, South Salmara-Mankachar.
