Though there are 12 more victims with whom the applicants could not settle, the said settlement could not be arrived at despite the willingness of the applicants as the applicants could not trace other 19 victims. 2. Learned advocate Ms. Fidelis states that trial is already in advance stage and, therefore, the applicants may be permitted to withdraw this petition at this stage, but this Court may observe the fact that the applicants’ settlement with 19 victims for which affidavits are filed in this petition. 3. Accordingly, in view of the above submission, without examining the merits of the case, the petition stands disposed of as R/CR.MA/5215/2023 ORDER DATED: 25/06/2025 withdrawn. However, the present withdrawal shall not affect the merits of the case before the learned Trial Court and the learned Trial Court may proceed with the trial without being influenced by the withdrawal of this petition.
