By way of instant application, prayer has been made on behalf of applicant/petitioner to permit him to visit Dubai w.e.f 05.08.2025 to 25.08.2025 through his private chartered plane, for which permission is sought on the spot from Director General Civil Aviation and his place of stay will be the house of the brother of the petitioner i.e. at Flat No. 201, Building C-402, Shabiya 10, Mussaffa, Abu Dhabi, UAE. It has been averred in the application that applicant/petitioner is in the business of civil aviation and as such, he is required to travel abroad frequently. Pursuant

24.07.2025, respondents/State has filed reply, opposing the prayer made on behalf of applicant/petitioner, on the ground that despite repeated opportunities, petitioner has not furnished relevant information as well as documents with regard to Windborne Air Pvt. Ltd. Company owned by the applicant/petitioner. While opposing the aforesaid plea taken by the respondents-State, Mr. Pankaj Negi, learned counsel for the petitioner, states that petitioner, who has not been made accused till date, has been fully cooperating. He states that whatever information was available with the petitioner stands already shared with the respondents, but yet he is being harassed unnecessarily for no fault of him. Since it is not in dispute that petitioner has not been named in the FIR in question till date and prior to filing of the application at hand, he was granted permission to visit abroad w.e.f 28.12.2024 to 31.12.2024, 04.01.2025 to 07.01.2025, 18.06.2025 to 28.06.2025 and 01.07.2025 to 15.07.2025 and during afore period, no adverse report was received against him, coupled with the fact that after his return, no complaint, if any, was ever made to this Court by the Investigating agency with regard to non-cooperation, if any, by the petitioner, there appears to be no impediment in allowing the present application.
In view of the above, present application is allowed and applicant/petitioner is permitted to visit Dubai w.e.f 05.08.2025 to 25.08.2025, subject to his furnishing surety bonds in the sum of Rs. 2,00,000/- to the satisfaction of learned Deputy Registrar(Judicial)/learned trial Court, with the undertaking to return to India, in any eventuality by 25.08.2025 and furnishing details of place of his stay during
such visit and to report to Police Station concerned within three days, after 25.08.2025. August 04, 2025
