THE PRESENCE OF THE PETITIONER WHO IS A CONVICT IS ESSENTIAL FOR PERFORMING TRADITIONAL AND LEGAL DUTIES. THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: - 3 - NC: 2025:KHC:16031 WP No. 10502 of 2025 CORAM: HON'BLE MR JUSTICE M.NAGAPRASANNA ORAL ORDER Heard the learned counsel Sri.Sirajuddin Ahmed, appearing for the petitioner and the learned High Court Government Pleader Sri.Shamanth Naik, appearing for the respondents. 2. The petitioner - convict is before this Court seeking his release on parole on the score that his sister marriage has been fixed to be performed on 21st April 2025. 3. The learned counsel for the petitioner takes this Court through the documents appended to the petition to demonstrate that the petitioner has not sought general parole at any point in time and is now in prison since 10.4 years. 4. The petitioner has appended an invitation of such marriage that is to be performed on 21st April 2025. - 4 - NC: 2025:KHC:16031 WP No. 10502 of 2025 5. In that light, I deem it appropriate to grant the petitioner - the convict parole for a period of 60 days to become operational from 19.04.2025. 6. For the aforesaid reasons, the following: ORDER (i) The Writ Petition is allowed in part. (ii) Mandamus issues respondent No.2 to consider the representation of the petitioner and release the petitioner on general parole for 60 days, from the forenoon of 19.04.2025 till the evening of 17.06.2025. (iii) Respondent No.2 shall stipulate strict conditions as are usually stipulated, to ensure the return of the detenue (CTP No.19329) to the gaol and that he shall not commit any other offence during the period of general parole. - 5 - NC: 2025:KHC:16031 WP No. 10502 of 2025 (iv) The convict (CTP No. 19329) shall mark his attendance in the jurisdictional police station, weekly once throughout the period of his general parole and it would be the responsibility of the jurisdictional police to take him to gaol, in the event, the convict would evade going back to the gaol, after the expiry of the period of general parole. (v) Registry is directed to communicate this order to respondent No.2, by way of electronic mail, forthwith.
