Crl.P.No.6421_2025 The Court made the following Order;
1. The
learned counsel for the petitioner submits that the petitioner is arrayed as Accused No.2 in Crime No.312 of 2025, on the file of Penamaluru Police Station, Krishna District, for the alleged offence under Section 109(1) read with Section 3(5) of the BNS, 2023.
2. The learned counsel for the petitioner submits that even as per the complaint, the accused No.1 is said to have attacked the 2'"'^ respondent. As seen from the complaint, it appears that the 2"'^found Accused No.1 and the petitioner herein in his house, and as soon as he entered the house, the nd accused No.1 struck the petitioner with rod. A complaint was filed by the 2 respondent, and the police have registered a case.
3. Considering the submissions that the petitioner did not abet her husband and that she has minor children totake care of,this Court is inclined to dispose off this criminal petition by directing the Station House Officer, Penamaluru Police Station, to complete the investigation without taking any coercive steps against the petitioner. However, this shall not preclude the Investigating Officer from filing the charge sheet/final report. The petitioner shall cooperate with the investigation. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
