GP FOR FINANCE PLANNING The Court made the following: 2 THE HON’BLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION No. 14980 OF 2024 ORDER: The Writ Petition is filed questioning inaction of the respondents in withholding an amounts of Rs.1,82,124/-, Rs.88,698/-, Rs.74,177/- and Rs.88,923/- even after finalizing the bills payable to the Petitioner in relation to works i.e., “1. Repairs to JCB in Chilakaluripet Municipality vide Agreement No.19/2023-24, dated 21.04.2023, 2. Supply arrangements of Refreshments and flower pots for Jagananna colony Revive meeting of Smt. Vidadala Rajini garu Hon’ble Minster and District Collector (Palanadu) and Housing MD Lakshman sha and other Employees in municipal office (council hall) Chilakaluripet Municipality, vide Agreement No.135/2023-24, dated 17.08.2023, 3. Laying of stone Dust in pot holes and Approaches and Road marigns for Festival of Sivaratri programme from Solasa vari veedi to Kantamma Tea stall 30th and 31st wards in Chilakaluripet Municipality, vide Agreement No.286/2022-23, dated 10.02.2023 and 4. Rectification of Leaks at Pandaripuram pumphouse and Malayadri Shop intake chamber in Chilakaluripet Municipality vide Agreement No.33/2023-24, dated 27.06.2023”. 2. When the matter is taken up for hearing, the learned Standing Counsel passed on written instructions received by him, signed by the Commissioner, Chilakaluripet Municipality, wherein it was mentioned at paragraph No.4 that the Petitioner had executed the works as stipulated under agreement referred above and that the payment could not be made due to lack of funds. It was 3 further mentioned that the Municipality will be paying the amounts as and when the amounts are released, without any delay. 3. In view of the aforesaid submissions and also considering the fact that there is no dispute with regard to the execution of works and the amounts due to the Petitioner, this Court is inclined to dispose of the Writ Petition with the following direction: (i) The Respondents are directed to pay the amounts due to the Petitioner within a period of four (04) months from the date of receipt of the copy of this order.
