Heard. 3. FIR in Crime No.230/2019 was registered by Tavarekere Police Station, Ramanagara, initially for offences punishable under Section 392 of IPC and Section 27 of Indian Arms Act, 1959, against unknown four persons, based on the first information dated 30.08.2019 received from Reddyshekar S/o Narashimalu. - 3 - NC: 2025:KHC:16729 CRL.P No. 4540 of 2025 4. After completing investigation in the said case, charge sheet has been filed against four persons and petitioner is arraigned as accused No.4 in the charge sheet. Bail application filed by the petitioner before the Jurisdictional Sessions Court in Crl.Misc.No.170/2025 was rejected on 05.03.2025. Therefore, petitioner is before this Court. 5. Perusal of the material on record would go to show that FIR in the present case was registered against four unknown persons initially for offences punishable under Section 392 of IPC and Section 27 of Indian Arms Act, 1959. It appears that petitioner who was arrested in some other case was produced before the Court in the present case under a body warrant on 10.10.2019 and on the said date he was remanded to police custody. 6. Material on record would also go to show that police have interrogated the petitioner in the present case and his confession statement was also recorded on 10.10.2019. It also appears that petitioner was enlarged - 4 - NC: 2025:KHC:16729 CRL.P No. 4540 of 2025 on bail in the main case in which he was arrested and therefore he was released from the jail. 7. It appears that subsequently the Court of learned Magistrate has taken coercive steps to secure the presence of the petitioner in the present case, and ultimately his presence was secured in the present case on 15.01.2025 and on the said date he was remanded to judicial custody. Bail application filed by the petitioner before the Jurisdictional Session Court in Crl.Misc.No.170/2025 was thereafter rejected on 05.03.2025. 8. It is brought to the notice of this Court that the last case registered against the petitioner is in the year 2019 and he has not involved in any case thereafter. In the other three cases which are registered against the petitioner in the year 2019, petitioner is said to have already been enlarged on bail. Considering the aforesaid aspects of the matter, I am of the opinion that the petitioner's prayer for grant of regular bail needs to be - 5 - NC: 2025:KHC:16729 CRL.P No. 4540 of 2025 answered affirmatively, subject to imposing appropriate conditions on the petitioner. Accordingly, the following:- ORDER The petition is allowed. The petitioner is directed to be enlarged on bail in C.C.No.4203/2022 pending before the Court of II Additional City Civil and JMFC, Magadi, arising out of Crime No.230/2019 registered by Tavarekere Police Station, Ramanagara, for offences punishable under Section 397 of IPC and Section 27 of Indian Arms Act, 1959, subject to the following conditions: a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear before the Station House Officer of Tavarekere Police Station, Ramanagara, on the 2nd Sunday of every month and mark his attendance between - 6 - NC: 2025:KHC:16729 CRL.P No. 4540 of 2025 10:00 a.m. and 1:00 p.m. till the criminal cases registered against him are disposed off; c) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; d) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; e) The petitioner shall not involve in similar offences in future; f) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
