Shamsher @ Bachchi S/o Mahendersingh, Aged About 20 Years, R/o Alapur, Police Station Akbarpur, Distt. Alwar. At Present Near Panchayat Ghar, Kasba Noganwa, Distt. Alwar. (Petitioners Are In Central Jail Alwar) ----Petitioners Versus The State Of Rajasthan, Through Pp. ----Respondent For Petitioner(s) : Mr. Ali Mohd. Khan For Respondent(s) : Mr. Jaiprakash Tiwari, PP HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 30/07/2025 1. The petitioners have preferred this bail application under Section 483 of BNSS in FIR No.0029/2025 registered at Police Station-Shivaji Park, District-Alwar for the offence under Section 303(2) of BNS. 2. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. The allegation against the present petitioners is theft of the Motor Cycle. He further submits that though there are several cases of similar nature against them but in all of them the petitioners are bailed [2025:RJ-JP:28955] (2 of 3) [CRLMB-7815/2025] out. He again submits that the petitioners are behind the Bars since 03.04.2025 and charge-sheet has been filed. The trial of the case may take considerable time, therefore no fruitful purpose would be served by keeping the petitioners in further custody, hence the bail application of the petitioners may be allowed. 4. Learned Public Prosecutor has vehemently opposed the bail application. 5. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case but without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners. 6. Accordingly, the bail application under Section 483 B.N.S.S. is allowed and it is ordered that the petitioners-(1) Amir Singh @ Amiri S/o Jagmohan and (2) Shamsher @ Bachchi S/o Mahendersingh shall be released on bail on their furnishing a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial court for their appearance before that Court on all the dates till conclusion of the trial. 7. Further, petitioners are directed to mark their presence fortnightly in every month for a period of six months before the SHO-Shivaji Park, District-Alwar. 8. Concerned SHO is directed to maintain a register for this purpose. In case the petitioners fail to mark their presence in the concerned Police Station as directed above, the concerned SHO is [2025:RJ-JP:28955] (3 of 3) [CRLMB-7815/2025] directed to immediately report the matter to the concerned Court in this regard. 9. If breach of any of the directions is reported or come to the notice of the Court and the petitioners are found involved in similar nature of offence, the same shall alone be a reason for the trial Court to cancel the bail granted to the petitioners by this Court.
