Heard the parties.
Bail application of the petitioner was earlier rejected by this Court vide B.A. No. 411/2025, by order dated 23.01.2025.
The petitioner has been made accused in connection with Lesliganj P.S. Case No. 43 of 2024, corresponding to N.D.P.S. Case No.06 of 2024, for the offence under Sections 17/20(ii)(b)/21/22 of N.D.P.S Act, pending in the court of learned Additional Sessions Judge-IX, Palamau at Daltonganj.
On 25.03.2024, at about 05:30 p.m., Lesliganj Police, on the basis of confidential information, raided the house of the petitioner and on search, 4.469 kgs of cannabis and 141 bottles of codeine cough syrup were recovered from there.
The quantum of seized cough syrup comes within the purview of commercial quantity. Learned Spl.P.P has submitted that the trial is under progress and the prosecution has examined five witnesses.
Considering the nature of allegation, I am not inclined to release the petitioner, on bail. Accordingly, the prayer for bail of the petitioner is rejected.
Learned Trial Court shall expedite the trial.
