Petition has been filed for transfer of Matrimonial Suit No. 3578 of 2023 by the opposite party/husband Mr. Chandan Bhattacharya. Respondent had filed petition for decree for divorce which is presently pending in the Court of learned Additional District Judge, 13th Court, Alipore, South 24- parganas. Learned Counsel submits that another petition under protection of women from Domestic Violence Act, 2005 being filed by the petitioner and a petitioner under Section 498A is pending consideration before the competent Court and the jurisdiction of learned District Judge, Paschim Medinipur. Learned Counsel for the petitioner submits that for the purpose of convenience and in order to avoid any conflict the decision the Matrimonial 2 Suit No. 3578 of 2023 is pending in the Court of Additional District Judge, 13th Court, Alipore, South 24-parganas may be withdrawn and assign to the Court of the competent jurisdiction of learned District Judge, Paschim Medinipur. Learned Counsel for the respondent on instruction has graciously stated that she has no objection to the same. In the view of the submission on behalf of the petitioner Matrimonial Suit No. 3578 of 2023 be withdrawn from the Court of the learned Additional District Judge, South 24- parganas and assign to the Court of competent jurisdiction, learned District Judge, Paschim Medinipur transfer to the Court of transferor to the transferee Court within 30 days from the received of the copy of the order. Copy of the order be sent to the transferor Court to the transferee Court. Urgent Photostat copy of this order be supplied to the parties. Parties are directed to transfer on 11th June, 2025.
