ORDER:
1. Learned counsel for the petitioner submits that the petitioner is owner, possessor and enjoyer of iand of an extent of Ac.1-75 cents in Sy.No.5/1C of Battuvaripalli Revenue Village Fields, Rama Kuppam Mandal Chittoor District, The name of the petitioner was mutated in the revenue records and pattadar

The petitioner submits that, Respondent No.4 is trying to interfere into the peaceful possession and enjoyment of the petitioner’s subject laHd. Questioning the inaction of Respondent Nos.3 & 4, the present writ petition filed. IS

Learned Government Pleader for Revenue placed on record written instructions furnished by the Tahsildar, Ramakuppam Mandal, Chittoor Distr in Roc.A/2025 dated 26.06.2025, wherein it is submitted that, the land Sy.No.5/1 admeasuring total extent of Ac.5-25 cents is classified as Sarkal-u Anadeenamu Punja (rounded by Anadeenamu) and denoted
“21.K. Lakshmi Bai patta granted in S.Q.206/53 dated 30.06.53 read w^h No.268/110 kpm dated 08.12.1964. CTR 268/65” as per Fair adangal of ttie Battuvaripalli revenue village. The resurvey is also completed to ttie Battuvaripalli revenue village. After completion of Resurvey, the joint LPM No.1 was given to the land an Ext.Ac5-36 cents of Battuvaripalli revenue village and put joint pattadar as I.N. Jayalakshmi w/o TM Raju 2. Smt. Saraswatamma w/o NV Trinadh and 3. Veeraragavulu s/o Prakash Rao (writ petitioner herein) of tfie land. Further, the respondents have not been disturbing/interfering the subject land measuring an extent of Ac.1-75 cents in Sy.No.5/1C or Join LPM No 1 ct in name ^s

During hearing, learned counsel for the petitioner, without touching the merits of the case, requested this Court to issue a direction to the respondents not to dispossess the petitioner from his land without following due process of law. 5. Learned Assistant Government Pleader for Revenue submits that, the respondents would follow due process of law and requested to pass appropriate orders. 6. Heard learned counsel for the petitioner, learned Government Pleader for Revenue and perused the material available on record. 7.
When the petitioner is in settled possession and enjoyment of the property he cannot be dispossessed, without following due process of law in view of the law declared by the Apex Court in
“Rame Gowda (dead) by L.Rs. v. . Therefore, if the petitioner is in M.Varadappa Naidu (Dead) by L.Rs. 1 » possession of the subject property, the respondents are
directed not to dispossess the petitioner from the subject property, except by due process of law. 2004(1) see 769

8. With the above direction, the writ petition is disposed of at the stage c admission with the consent of both the counsel. No costs.
