The present contempt petition is filed alleging wilful and deliberate violation of this Court’s order dated 19.12.2023 passed in WP(C) No. 7270/2023. Page No.# 2/2 2. By the aforesaid order dated 19.12.2023, the petitioners were granted liberty to approach the competent authority by filing their respective applications seeking a reference to arbitration in terms of Section 3G(5) of the National Highways Act, 1956. It was further directed that if the petitioners file their respective applications, the Competent Authority shall refer such dispute to arbitration in terms of Section 3G of the NH Act, 1956 within a period of 30 days thereafter. 3. Learned counsel for the petitioner submits that even after filing of such application in pursuance of the order dated 19.12.2023, the matter has not been referred to arbitration. Accordingly, this contempt petition is filed. 4. Mr. S. Dutta, learned Standing counsel, CALA has submitted a copy of the instruction, which goes to show that the matter has already been referred to arbitration and the matter is fixed for hearing on 08.04.2025 at 03:00 pm in the office chamber of the Arbitrator-cum-Secretary to the Govt. of Assam, Revenue & Disaster Management, Assam, Room No. 223, Assam, Block ‘D’, 2nd Floor, Assam Secretariat, Dispur. 5. In view of the aforesaid, learned counsel for the petitioner submits that this contempt petition can be closed. 6. Accordingly, this contempt petition stands closed. 7. A copy of the instruction furnished by the learned counsel for the respondent be kept on record and the same has already been furnished to the learned counsel for the petitioner.
