Borah, the learned Additional Public Prosecutor appearing for the State of Assam. 2. This is an application under Section 482 of the BNSS, 2023 praying for grant of pre- arrest bail in respect of Special (NDPS) Case No. 134/2022 arising out of Bezaricherra P.S No. Page No.# 2/2 168/2022 pending in the court of the learned Special Judge, Sribhumi. 3. The petitioner was shown as an absconder in the supplementary charge sheet. This Court, on earlier occasion, i.e. on 20.12.2024, stayed the operation of the Non-Bailable Warrant of arrest (NBWA) as well as the P & A issued against the petitioner. 4. The learned counsel for the petitioner Mr. Ahmed has submitted that the petitioner is willing to context the case. Mr. Ahmed submits that the petitioner has unnecessarily been arrayed in this case because the registration of the vehicle of the petitioner resembles with the vehicle used in the alleged offence. 5. I have considered the submissions made by the learned counsel of both sides. 6. Since the petitioner is interested in facing the trial, he deserves to be given one opportunity to that effect. Therefore, his prayer is allowed. 7. It is hereby directed that the petitioner Rajpal Singh Poonia shall appear before the learned Special Judge, Sribhumi in respect of Special (NDPS) Case No. 134/2022. On his appearance, he shall be released on bail of ₹25,000/- (twenty five thousand) with a surety of like amount to the satisfaction of the learned Special Judge, Sribhumi.
