The petitioners are apprehending their arrest in connection with Dumka (M) (Dighi O.P.) P.S. Case No.85 of 2025, for the alleged offences registered under Sections 126(2), 115(2), 117(2), 118(2), 109 and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned C.J.M., Dumka. 3. Learned counsel appearing for the petitioners submits that there are general and omnibus allegation against the petitioners and the scuffle took place at the spur of the moment and in view of that the anticipatory bail may kindly be granted. 2025:JHHC:23004 --2-- A.B.A. No. 4215 of 2025 4. Learned counsel appearing for the State opposes the prayer and submits that two persons have received grievous injury due to assault and in view of that the anticipatory bail may not be granted. 5. It has come in the impugned order that Nitish Kumar Hembrom and Shrawan Tudu received injury i.e. bleeding from right eye, ball lacerated, no vision and after NCCT right eye globe was found ruptured and patient was referred to higher center and injury is grievous in nature. 6. In the attending facts and circumstances, I am not inclined to grant anticipatory bail to the petitioners, hence, the prayer for anticipatory bail of the petitioners is hereby rejected.
