In view of the submissions made by learned counsel for the applicant-appellant and for the reasons mentioned in the application, the application for condonation of delay is allowed and the delay of 113 days which occurred in filing the restoration application, is condoned. 4. The restoration application has been filed by the applicant- appellant for restoration of Civil Misc. Appeal No.4483/2007 to its original number, which was dismissed on 28.10.2015 in compliance of peremptory order dated 13.08.2015. 5. Considered the submissions. 6. Having regard to the submissions made by counsel for the applicant-appellant and for the reasons mentioned in the restoration application, this Court deems it just and proper to [2025:RJ-JP:25480] (2 of 2) [CRES-197/2016] allow this restoration application and restore the appeal to its original number. 7.
