The present appeal is directed against impugned judgment of conviction and order of sentence dated 28.01.2008 passed by the Special Judge, Special Court, Raipur (C.G.) in Special Sessions Trial No. 35/2006, whereby and whereunder, the appellant stands convicted under Sections 506 (B) of IPC and Section 3 (I) (xi) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 & 2 sentence to pay fine of Rs.1500/-, in default thereof to undergo 01 months S.I. & R.I. for six months with fine of Rs.3000/- respectively, with default stipulation. 2. In pursuance of this Court’s order dated 19.02.2025, bailable warrant was directed to be issued against the appellant and the same has been received with a note that the sole appellant left for heavenly abode on 04.05.2022. 3. The service report of the bailable warrant is supported by the report of S.H.O., Khamtarai, Raipur (C.G.) with the death certificate of the appellant. 4. Learned State counsel has verified the fact and confirms the death of sole appellant on 04.05.2022. 5. Thus, in view of the death of sole appellant and in absence of any application for bringing his legal representatives on record, the appeal abates and the same is dismissed as abated.
