Accused Nos.1 and 2 in Crime No.92/2025 registered by Sira Police Station, Tumakuru, for the offences punishable under Sections 108 and 190 of BNS, 2023, are before this Court under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.92/2025 was registered by Sira Police Station, Tumakuru, against the petitioners and four others for the aforesaid offences based on the first information dated 04.03.2025 received from Radhamma, mother of deceased Viveka @ Manu. During the course of investigation, petitioners who are arraigned as accused Nos.1 and 2 were arrested on 06.03.2025 and subsequently, remanded to judicial custody. Their bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.379/2025 and Crl.Misc.No.380/2025 were rejected on 19.03.2025. Therefore, they are before this Court. - 3 - NC: 2025:KHC:13911 CRL.P No. 4333 of 2025 4. Learned Senior Counsel for the petitioners having reiterated the grounds urged in the petition has prayed to allow the petition. He submits that there is no nexus between death of the deceased and the alleged incident that had taken place earlier. Petitioners have no other criminal antecedents. Accordingly, he prays to allow the petition. 5. Per contra, learned HCGP has opposed the petition on the ground that investigation in the case is under progress. Accordingly, he prays to dismiss the petition. 6. A perusal of the material on record would go to show that deceased was allegedly selling mushroom and petitioners appears to have purchased mushroom from him. It is alleged that, subsequently, petitioners had abused the deceased for the reason that he was supplying them low quality mushroom and it is also alleged that they had demanded repayment of the money paid by them. Deceased has committed suicide on 04.03.2025 by hanging himself. A perusal of the averments found in the first information would go to show that no such incident had taken place immediately prior to the alleged date of suicide committed by deceased which would have either - 4 - NC: 2025:KHC:13911 CRL.P No. 4333 of 2025 abetted or instigated him to commit suicide. Petitioners who have no other criminal antecedents are in custody from 06.03.2025. Considering the nature of allegations found in the first information as against the petitioners, who are in custody, I am of the opinion that their prayer for regular bail needs to be answered affirmatively. Accordingly, the following order:- 7. The petition is allowed. The petitioners are directed to be enlarged on bail in Crime No.92/2025 registered by Sira Police Station, Tumakuru, for the offences punishable under Sections 108 and 190 of BNS, 2023, subject to the following conditions: a) Petitioners shall execute a personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioners shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons; c) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses; - 5 - NC: 2025:KHC:13911 CRL.P No. 4333 of 2025 d) The petitioners shall not involve in similar offences in future; e) The petitioners shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against them is disposed off.
