JUSTICE PRAVEER BHATNAGAR
Order 04/03/2025
1. Apprehending his arrest in connection with FIR No. 291/2023 registered at Police Station Mandawar (Dausa), District Dausa for the offence(s) under Sections 420 and 406 of IPC, the accused- petitioner has preferred this anticipatory bail application under Section 438 Cr.P.C.
2.
Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that the matter between the accused-petitioner and the complainant is purely of civil nature. The accused- petitioner is ready and willing to cooperate with the investigation, therefore, anticipatory bail of the accused-petitioner may be allowed.
3. Learned Public Prosecutor as well as learned counsel for the complainant vehemently oppose the anticipatory bail application. It is contended by learned counsel for the complainant that
[2025:RJ-JP:9451] (2 of 2) [CRLMB-7277/2024] charge-sheet has already been produced against the accused- petitioner before the concerned Court under Section 299 of Cr.P.C. The accused-petitioner has duped the complainant and obtained Rs.13,50,000/- from the complainant and thereafter did not pay it, therefore, the anticipatory bail application of the accused- petitioner may be dismissed.
4. Heard and perused the material available on record.
5. Considering the fact that the charge-sheet against the accused-petitioner has already been submitted under Section 299 of Cr.P.C. and prima-facie after investigation, police has found offences under Sections 420 and 406 of IPC made out against the accused-petitioner, therefore, this Court is not inclined to enlarge the accused-petitioner on bail.
6. Accordingly, the bail application of the accused-petitioner is hereby, dismissed.
