The petitioner is challenging the registration of Crime No.148 of 2025, on the file of Gopalapatnam Police Station, Visakhapatnam District, for the alleged offence under Section 318(4), read with 3(5) of the BNS, 2023, and Sections 21(1)(2)(3) of the TBUDS Act. The FIR was registered on 05.06.2025,in relation to allegations of running unauthorized chits. 2. The learned counsel for the petitioner submits that the provisions of the TBUDS Act would not be applicable, even as per the facts of the case. It is further submitted that the petitioner has been declared insolvent vide I.P.No.57 of 2024, and that the 2nd respondent in the insolvency proceedings has now filed a false complaint alleging various offences. It is also submitted that the police have registered a case for offences allegedly committed more than one year prior to the registration of the crime. 3. Considering the same, the police aredirected to complete the investigation in accordance with law, duly taking into consideration in the insolvency proceedings filed by the petitioner, which are pending before the appropriate Court. 4. Accordingly, the criminal petition is dismissed.
