1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.89/2025 registered at Police Station – Gharghoda, District-Raigarh (C.G.) for the offences punishable under Sections 318(4) and 316(5) read with Section 3(5) of BNS.
2. As per Case of the prosecution the complainant namely Vimal Kumar Singh (Branch Manager, Apex Bank Tamnar) made VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2025.05.14 11:48:16 +0530
2 complaint to the Police Station against Manoj Kumar Gupta (Assistant Society Manager) and other persons about the financial loss and shortage of paddy, which happened in the Paddy Purchase Centre Tenda, Nawapara and stated that as per the report submitted by the investigating officer dated 25-02- 2025, there was shortage of paddy in the Centre of 7159.60 Quintal and also loss due to missing of Bardana, thereby total loss of Rs.2,27,65,260/- was found in relation to the paddy purchase centre, cause of which the FIR got registered against Manoj Kumar Gupta and other persons in which the present applicant have also been made as accused.

Learned counsel for the applicant submits that the applicant is innocent and she has been falsely implicated in the present case. He would submit that the present applicant having no involvement in the aforesaid crime, applicant is a daily wager in the said society. He also submits that the work of the applicant in the said society is only making entry in the computer about the transaction, which have been entered in the Register of the paddy Purchase Centre in respect of the purchase of paddy and the applicant not have any responsibility for doing any other work, cause of which the applicant have been falsely implicated in the present case, investigation and trial are likely to take time, therefore, he submits that the present applicant is entitled to be released on anticipatory bail.
4. On the other hand, learned State counsel opposes the prayer for grant of anticipatory bail.

5. I have heard learned counsel for the parties and perused the case diary.
6. Considering the facts & circumstances of the case, gravity of offence, also considering the fact that the total loss of Rs. 2,27,65,260/- was found in relation to the paddy purchase centre, as such, I am not inclined to grant anticipatory bail to the applicants.

Accordingly, the anticipatory bail application of the applicant– Mukesh Yadav, filed under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved in Crime No.89/2025 registered at Police Station – Gharghoda, District-Raigarh (C.G.) for the offences punishable under Sections 318(4) and 316(5) read with Section 3(5) of BNS is rejected.
