The present Cr.MP has been filed by the petitioner with the following prayer:- “It is, therefore most respectfully, prayed that this Hon’ble Court may kindly be pleased to stay the effect and operation impugned FIR against the petitioner pursuant to FIR/ Crime No. 17/2018, for the offences punishable U/s 420 of IPC at P.S. Kondagaon, Dist- Kondagaon (CG), pending as Special Case No. 01/2020 (CGPID), before Special Judge (CGPID), Dist- Kondagaon (CG), where no allegations even as per the prosecution for handling and managing the affairs of the Company have been alleged 2 over the petitioner herein. Till the final disposal of this petition, in the interest of justice.” 2. It transpires from the record that there is no interim order passed in the present case. Moreover, a pointed query being made to the learned counsel for the petitioner regarding the status of the present case before the learned trial Court, he stated that he has no information regarding the same as his client is not responding. The learned counsel for the respondent has also pointed out that the complainant has not been made a party in the present case. 3. In view of the above, we are not inclined to interfere in the present case as from the submission made by learned counsel for the petitioner it appears that the petitioner has lost his interest in pursuing the matter due to efflux of time 4. Accordingly, the Cr.MP is dismissed on this ground alone. 5. The petitioner is at liberty to raise his objection before the learned trial Court at appropriate stage, if the matter stills survives. 6. Copy of this order be sent to the learned trial Court for the necessary information and compliance.
