( 2025:JHHC:26237 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No.4651 of 2025 ------ Vinod Sao, aged about 52 years, son of Late Pratap Sahu @ Shiv Prasad Sahu, resident of Village-Kanda, P.O. & P.S. Bishrampur (Nawa Bazar), Dist.-Palamu, Jharkhand. … Petitioner Versus The State of Jharkhand … Opposite Party ------ CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mr. Ritesh Kr. Pathak, Advocate For the State : Ms. Shweta Singh, Addl.P.P. For the Informant : Mr. Raj Vardhan, Advocate ------ Order No:-02 Dated:-29-08-2025 Heard the parties. This is the second journey of the petitioner with the prayer for anticipatory bail, earlier the prayer for anticipatory bail of the petitioner was rejected vide order dated 26.03.2025 in A.B.A. No.1976 of 2025. It is jointly submitted by the learned counsel for the petitioner and the learned counsel for the informant that the fresh ground is that a compromise has been entered into between the parties and in this respect, learned counsel for the petitioner and the learned counsel for the informant draws attention of this Court to the I.A. No.11551 of 2025 which is supported by the separate affidavits of the sister-in-law and pairvikar of the petitioner as well as the informant; wherein it has categorically been mentioned that after enquiry, the informant came to know that the petitioner has falsely been implicated due to prior dispute between the parties and also on pressure exerted by the neighbours, hence, the informant has no objection if the petitioner is released on bail. The Learned counsel for the petitioner submits that the allegations against the petitioner are general and omnibus in nature. It is next submitted that the co-accused Ashok Prasad has already been admitted to regular bail, keeping in view the compromise between the parties. Considering the submissions of the counsels and the fact as discussed above, I am of the opinion that it is a fit case where the above named petitioner be given the privileges of anticipatory bail. Hence, in the event of his arrest or surrender within a period of six weeks from the date of this order, he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Chatra, in connection with Pratappur P.S. Case No.140 of 2024 with the condition that the petitioner will cooperate with the investigation of the case and appear before the Investigating Officer as and when noticed by him and will furnish his mobile number and a copy of his Aadhar Card in the court below with the undertaking that he will not change his mobile number during the pendency of the case subject to the conditions laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
