This is an application under Section 482 of the BNSS, 2023 praying for anticipatory bail in respect of Mayong P.S. Case No.114/2024, registered under Sections 127(2)/ 118(2)/ 117(2)/ 305/3(5) of the BNS, 2023. 3. Sri Mukul Das has lodged an FIR before police on 14.10.2024 alleging that on 13.10.2024 at about 8 P.M., while his son Man Prasad Das was returning home from market, Sri Tapash Biswas, Durgacharan Biswas, Dipangkar Biswas, Minati Biswas and Pramud Ray had attacked him with sharp weapons. It is alleged that because of the injuries, Man Prasad Das got 20 stitches on his head. 4. Mr. Phukan has submitted that the wife of Tapash Biswas had eloped with Man Prasad Das and both were living separately in another place and this is the reason, why Tapash Biswas and other persons had attacked Man Prasad Das on that day. According to Mr. Phukan, the present petitioner Sri. Pramud Ray, aged about 64 years had tried to intervene between the parties but he is no way associated to the dispute between the parties. 5. Mr. Chutia has submitted that Man Prasad Das sustained injuries and he was taken to the hospital for treatment and later on discharged. 6. Mr. Goswami has submitted that Man Prasad Das had sustained simple injuries caused by blunt weapon. 7. Considering all these facts, this Court is of the opinion that the present petitioner does not deserve to be detained in custody. His pre-arrest bail application is allowed. 8. It is hereby directed that in the event of arrest in connection with Mayong P.S. Case No.114/2024, registered under Sections 127(2)/ 118(2)/ 117(2)/ 305/3(5) of the BNS, 2023, the petitioner, Sri.
Pramud Ray shall be released on bail of ₹20,000/- with a surety of like amount to the satisfaction of the arresting authority. 9. The petitioner shall cooperate with the police investigation as and when required. Page No.# 3/3
