THE HON’BLE SRI JUSTICE HARINATH.N WRIT PETITION No.17674 OF 2025 ORDER:
1. The petitioner is apprehending the acquisition of his property in the proposed road widening by the 2nd respondent. It is submitted that the 2nd respondent authority, without issuing any notice, are attempting to dispossess and acquire the petitioner’s land without following the procedure as contemplated under law.
2. The learned standing counsel appearing for the 2nd respondent submits that the petitioner is only a tenant of the property and that he had earlier filed a similar writ petition in W.P. No. 24174 of 2020 along with others. The said writ petition was disposed of by this Court on 17.12.2020, directing the respondents to follow the due process of law in the event they require the land of the petitioner for any public purpose. It is further submitted that the 2nd respondent is proceeding with the acquisition of the land, subject to the landlord surrendering the same for the purpose of road widening.
3. On the contrary, the learned counsel for the petitioner submits that the petitioner is the owner of the property, and therefore, any action by the 2nd respondent, either for acquisition or dispossession, they would have to follow the due process of law.
4. Considering the submissions, the writ petition is disposed of, making it clear that the respondents shall follow the due process of law in the

event the petitioner’s property is required for any public purpose. No costs.
