The petitioner is facing trial in C.C.No.56 of 2025, on the file of the Judicial Magistrate of First Class, Dhone, for the offence under Sections 138 and 142 of the Negotiable Instruments Act, 1881. 2. The learned counsel for the petitioner submits that the petitioner has repaid the cheque amount and the outstanding liability, if any, due payable by the petitioner to the 2nd respondent, and relies on the alleged receipt, which is exhibited as A1, said to have been by one A. Rama Durga. 3. It is submitted that as the outstanding amount has been repaid, the complaint deserves to be quashed. 4. Heard the learned counsel for the petitioner. 5. Considering the submission that the petitioner is disputing the liability, it is left open for the petitioner to raise all these grounds before the trial Court, as it would be appropriate for the trial Court to consider all these issues when the matter is taken up for trial. 6. Accordingly, the criminal petition is disposed off.
