Mr. Ramij Mujsi Ms. Muskan Agarwal …for the petitioner This application under Article 227 of the Constitution of India is at the instance of the respondent praying for a direction upon the learned Judge, 13th Bench, city Civil Court at Calcutta to dispose of Title Appeal No. 31 of 2014 expeditiously. Learned advocate appearing for the petitioner submits that this Court by an order dated October 9, 2023 in CO 3119 of 2023 (Meraj Rashid –Vs.- Syed Tarvez Hasan & Ors.) directed the learned Judge of the first appellate court to dispose of the appeal as expeditiously as possible but preferably by the end of January, 2024 without granting any unnecessary adjournment to either of the parties. He submits that in spite of such direction, the appeal is still pending. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite parties or upon the learned advocate representing the opposite parties before the learned first appellate court. From the order-sheets appended to this application this Court finds that May 19, 2025 has been fixed for hearing of the application under Order 41 Rule 27 of the Code of Civil Procedure along with the hearing of the appeal. In the light of the submission made by the learned advocate for the petitioners and taking note of the fact that this Court in CO 3119 of 2023 passed a direction for expeditious hearing of the appeal, the learned Judge, 13th Bench, City Civil Court at Calcutta is further requested to take up the hearing of the application under Order 41 Rule 27 CPC along with appeal on the next date fixed, i.e., on May 19, 2025 and to dispose of the same as expeditiously as possible but preferably by the end of the month of September, 2025 without granting any unnecessary adjournments to either of the parties.
