For Petitioner : Mr.T.Muruganantham For Respondent : Mr.R.Vinothraja Government Advocate (Criminal Side) COMMON ORDER Since the issue involved in these cases is one and the same, these cases are taken up together and decided by this common order. 2.Crl.OP.No.29910 of 2025 is filed to call for the records relating to notice dated 20.09.2025 issued by the Inspector of Police, Karipatti Police Station and quash the same. 3.Crl.OP.No. 29916 of 2025 is filed to call for the records relating to undated notice issued by the Inspector of Police, Vaazhapadi Police Station and quash the same. 4.The learned counsel for the petitioner would submit that the petitioner is a Non-Banking Financial Company; one Meena W/o.Venkatesh, who is residing at No.3/48, 303A, Kalottam Street, Ammapalayam, Salem, had pledged certain jewels with the petitioner and obtained loan; while so, the respondent had sought certain information from 2/6 https://www.mhc.tn.gov.in/judis https://www.mhc.tn.gov.in/judis
Crl.O.P.No.29910 & 29916 of 2025 the petitioner regarding the jewels vide the impugned notices; the impugned notices do not prescribe any provision, under which, they had been issued and thereby, he would seek to quash the notices issued by the respondent in both the cases.
5.Per contra, the learned Government Advocate (Crl.Side) appearing for the respondent would submit that the said Meena and one Venkatesh are wife and husband respectively; Venkatesh is an accused in Crime No.441 of 2024 for the offences under Sections 331 (4) and 305 (a) of BNS registered by the Vaazhapadi Police Station and Crime No.334 of 2025 for the offences under Sections 331 (3), 331 (4) and 305 of BNS registered by the Karipatty Police Station; during the course of investigation, the said Venkatesh has confessed that through his wife, he has pledged the stolen property in the petitioner financial institution and obtained loan; the respondent police have merely issued notice seeking information only with regard to the jewels pledged by the said Meena; during the course of investigation, the respondent has also instructed the petitioner financial institution not to release the jewels to any one till the investigation is over; other than that, the respondent has stated nothing. Crl.O.P.No.29910 & 29916 of 2025 release the jewels. Other than that, the respondent police have not stated anything and they have not asked for the jewels. 9.Therefore, this Court is of the view that the petitioner is bound to give information to the respondent police during the course of investigation and it is pre-mature to quash the impugned notices at this stage.
Further, this Court finds no illegality in the notices issued by the respondent. 10.Accordingly, these petitions stand closed and the petitioner is
