This writ petition is filed under Article 226 of the Constitution of India claiming the following relief: “to issue the Writ, Order or Orders more particularly one in the nature of Writ of Mandamus by declaring the proceedings issued by the respondent No 2 vide D.Dis.E/1/656/2024 dt.03.11.2024 and order of the 4th respondent vide RcB. 282/2007 dt.29.04.2008 is as illegal arbitrary and consequently direct the respondents not to interfere with the peaceful possession of enjoyment of the case over the agricultural land to an extent of Ac. 2.70 cents and Ac.0.67 cents in Sy.No.411/1A2 and 411/A2 totally an extent of Ac. 03.37 cents situated in Kadavaluru Village, SPSR Nellore district by setting aside the orders of the 2"^ dt. 3.11.2024 and 4**^ respondent dt.29.04.2008.” The case of the petitioner in nutshell is that, the 2"'^ respondent/Joint 2. Collector vide order in D.Dis.El/656/2024 dated 03.11.2024, stated that the petitioner purchased the assigned land (subject land) through registered sale deed and the original assignee sold away the land to the petitioner by violating conditions of patta as well as Rule 3 of the A.P. Assigned Lands (POT) Act, 1977 and directed the Tahsildar to maintain land of an extent of Ac. 1-45 cents in Sy.No.411/2-1A2 and Ac.0.67 cents in Sy.No.411/2-1B of Kodavalur Village w 4 N- W.P.No.15837 of 2025, and Mandal under the control of the Government and to be included in the Prohibitory Property list. The petitioner preferred an appeal before the Chief Commissioner of Land Administration, wherein the appeal was returned on 28.03.2025-, giving liberty to the petitioner to approach the appropriate forum. Thereupon, the petitioner filed a revision petition before the 1®* respondent, which is pending consideration. The 1®* respondent has neither considered nor passed any orders on the revision petition filed by the petitioner. Be that as it may, the 4^" respondent forcibly entered into the subject land and interfered with the possession of property of the petitioner. Therefore, the petitioner, aggrieved by the inaction of respondents in not disposing of the Revision Petition and also interfering with the possession of the petitioner filed this writ petition. 3. During hearing, learned counsel for the petitioner reiterated the contentions and requested this Court to issue a direction as claimed in the Writ Petition. 4. On the other hand, learned Government Pleader for Revenue submits that the revision petition would be considered and appropriate orders would be passed by the 1®* respondent. 5. The delay in not disposing of the Revision is violative of Article 300-A of Constitution of India. Therefore, this Court deems it appropriate to direct the 1®* respondent to consider and dispose of the revision petition, if any pending, within six (06) months from the date of receipt of a copy of this order, after / 5 NV,J W.P.No.l5837of2025 providing opportunity of hearing to the parties concerned. Till disposal of the revision petition by the 1®* respondent, status quo shall be maintained the parties concerned in respect of the possession of the property.
