cria-2207.19 1 IN THE HIGH COURT OF JUDICATURE AT BOMBAY BENCH AT AURANGABAD 909 CRIMINAL APPLICATION NO. 2207 OF 2019 KAILASH S/O. PREMRAJ GUNJAL AND ANR VERSUS THE STATE OF MAHARASHTRA AND ANR ... Ms. P.R. Bharaswadkar, A.P.P. for Resp. No.1. ... CORAM: SMT. VIBHA KANKANWADI AND HITEN S. VENEGAVKAR, JJ. DATE : 20th SEPTEMBER, 2025 ORDER : 1. Mr. Naik, learned Advocate for the applicants submits that he had given no objection to the applicants for engaging another Advocate of their choice, on 8th August 2023. He places on record photocopy of the no objection on Vakalatnama. Therefore, his appearance is discharged. It appears that in spite of giving no objection by him, another Advocate has not filed the Vakalatnama. 2. Learned APP informs that non-bailable warrant has been issued against the applicants on 16th August 2024 and yet it has 2025:BHC-AUG:25951-DB cria-2207.19 2 not been executed or it has not been git cancelled. 3. Thus, it appears that the present applicants are not following the law and procedure. Under such circumstance, we do not find this to be a fit case where we should exercise our powers under Section 482 of the Code of Criminal Procedure in favour of the applicants. 4. The Application stands dismissed. [HITEN S. VENEGAVKAR] [SMT. VIBHA KANKANWADI] JUDGE JUDGE asb/SEP25
