No. 221 of Namburu Village to extent of Ac 0.64 cents as per the Rc No. 196/2022 Dated 15-07-2022 of the Respondent No 4 is arbitrary, illegal, unconstitutional and consequently direct the respondents to survey and demarcate the land and pass such ” 2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader appearing for the respondents. 3. The learned counsel for the petitioner submits that the petitioner is the absolute owner and possessor of the land admeasuring to an extent of Ac.0.64 cents in Sy.No.221 of Namburu Village & Mandal, Guntur District. The petitioner acquired the subject land by way of succession. While things stood thus, some third parties are trying to interfere with the petitioner’s peaceful possession in respect of the subject property. Pursuant to which, the petitioner submitted a representation to the 2"^^ respondent, who accordingly 4 directed the 4^'^ respondent to take necessary action. Pursuant to the said direction, the 4*^ respondent instructed the 5^'^ respondent to conduct a survey and demarcation of the subject land, as per the proceedings in Rc.No.196/2022, dated 15.07.2022. In compliance, the 5*^ respondent issued a notice in Form-ll under Section 23 of the Andhra Pradesh Survey and Boundaries Act, 1923 on 18.07.2022, proposing to conduct the survey. However, despite the issuance of the said notice, no further action has been taken by the respondents till date. Hence, the Writ Petition. 4. On the other hand, the learned Assistant Government Pleader appearing for the respondents submits that if the survey is not completed pursuant to the notice dated 18.07.2022, the 5^*^ respondent will complete the same and will pass appropriate orders within a reasonable time in accordance with law. 5. Having regard to the submissions of the learned counsel for the petitioner, the learned Assistant Government Pleader for the Revenue and on perusal of the material available on record, this Court is of the considered view that the present Writ Petition can be disposed of directing the 5^^ respondent to complete the survey pursuant to the notice dated 18.07.2022 by observing the principles of the Andhra Pradesh Survey and Boundaries Act, 1923, within a period of three (03) months from the date of receipt of a copy of this order or 5 \ 0 Otherwise issue proceedings why the survey has not been conducted directed. as 6. In the result, the Writ Petition is disposed of. There shall be no order as to costs. Consequently, Miscellaneous Petitions, if any, pending in the Writ Petition shall stand closed.
