The complainant has apprehended that Sunny Kumar (applicant) might have enticed away the child victim, as, he was also not available from that date. On 9.11.2024, ASI Vinod Kumar visited the spot and prepared the spot map. As per the documents, produced by the complainant, before the Police, the date of birth of the child victim was found to be 8.6.2008. 7.2 Thereafter, on the transfer of ASI Vinod Kumar, further investigation was entrusted to ASI Mohinder Singh. 12.
Considering the number of witnesses, chances of conclusion of trial against the applicant, are not so bright in near future, as such, no useful purpose would be served by keeping the applicant in judicial custody, that too, for the indefinite period. 13. The another fact, which has rightly been highlighted by the learned Senior Counsel, appearing for the applicant, is that the applicant is 21 years of age and in case, he is kept in judicial custody, at this young age, he may come in contact with the hardened criminals, which would adversely affect his carrier. Considering the said argument of learned Senior Counsel, appearing for the applicant, this Court is of the view that no useful purpose would be served by keeping the applicant in judicial custody, as he is in judicial custody since 7.3.2025, till date. 14. Except the present case, no other case is stated to have been registered, against the applicant. As such, presumption of innocence is still available to the applicant. 15. The detailed discussions about the case of the prosecution, at the time of deciding the bail application, should be avoided, as the purpose of a bail hearing is not to decide the guilt or innocence of the accused, which would be proved during the trial. 7 2025:HHC:29196
16. So far as objection of learned Addl. A.G. qua the fact that applicant is resident of Uttar Pradesh and he may not be available for trial, is concerned, for that apprehension, reasonable conditions can be imposed, upon the applicant, in case, he is ordered to be released on bail. 17. Considering all these facts, this Court is of the view that the bail application is liable to be allowed and is accordingly allowed. 18.
Consequently, the applicant is ordered to be released on bail, during the pendency of trial, arising out of FIR No. 38 of 2024, dated 8.11.2024, under Sections 137 (2) and 64 of the BNS, and Section 4 of POCSO Act, registered with Women Police Station, Baddi, District Solan, HP. on his furnishing personal bond in the sum of Rs. 50,000/-, with two sureties in the like amount, to the satisfaction of the learned trial Court. 19. This order, however, shall be subject to the following conditions:- a) Applicant shall regularly attend the trial Court on each and every date of hearing and if prevented by any reason to do so, seek exemption from appearance by filing the appropriate application; b) Applicant shall not tamper with the prosecution evidence nor hamper the investigation of the case, in any manner, whatsoever; c) Applicant shall not make any inducement, threat or promises to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or the Police Officer, and
8 2025:HHC:29196 d) Applicant shall not leave the territory of India without the prior permission of the Court. 20. Any of the observations, made herein above, shall not be taken, as an expression of opinion, on the merits of the case, as these observations are confined, only to the disposal of the present bail application. 21. It is made clear that the respondent-State is at liberty to move an appropriate application, in case, any of the bail conditions is found violated by the applicant. 22. The Registry is directed to forward a soft copy of the bail order to the Superintendent of District Jail, Solan, through e- mail, with a direction to enter the date of grant of bail in the e- prison software. 23.
In case, the applicant is not released within a period of seven days from the date of grant of bail, the Superintendent of District Jail, Solan is directed to inform this fact to the Secretary, DLSA, Solan. The Superintendent of District Jail, Solan, is further directed that if the applicant fails to furnish the bail bonds, as per the order passed by this Court within a period of one month from today, then, the said fact be submitted to this Court. 9 2025:HHC:29196
