Neutral Citation No. - 2025:AHC:40656-DB HIGH COURT OF JUDICATURE AT ALLAHABAD (Sl. No. 42) Court No. - 21 Case :- WRIT - C No. - 5193 of 2025 Petitioner :- Shri. Tribhuvan Nath Respondent :- State Of Uttar Pradesh And 6 Others Counsel for Petitioner :- Chandra Bhushan Singh,Mohit Kumar Singh Counsel for Respondent :- C.S.C.,Pawan Kumar Singh Hon'ble Manoj Kumar Gupta,J. Hon'ble Anish Kumar Gupta,J. 1. Sri B.K. Ojha, learned counsel has put in appearance on behalf of respondent- Development Authority. 2. The petitioners have challenged a show cause notice dated 8.2.2024 issued by the Competent Authority, Prayagraj Development Authority, Prayagraj requiring the petitioner to show cause as to why constructions made over a piece of land measuring 42ft x 90ft without any sanction of builing plan be not demolished. 3. Learned counsel for the petitioner submits that the respondents are trying to illegally grab the land of the petitioner and instead of paying compensation to the petitioner they have issued the impugned show cause notice. 4. It is not disputed that constructions of the petitioner are still in existence over the said land and we find no evidence on record to establish that the Development Authority is staking any claim of title over the said land. 5. In such circumstances, we find no good reason to interfere with the impugned show cause notice. It is left open to the petitioner to submit his reply to the same, if so advised. 6. The petition stands disposed of accordingly. Order Date :- 20.3.2025 Kirti (Anish Kumar Gupta, J.) (Manoj Kumar Gupta, J.) Digitally signed by :- SMT KIRTI MISHRA High Court of Judicature at Allahabad
