This Hon'ble Court may kindly be pleased to issue an appropriate writ directing the respondent no. 3 to take necessary steps to constitute a team for Demarcation of Digitally signed by NADIM MOHLE -2- the land of the Petitioners. 10.2. This Hon'ble Court may kindly be pleased to issue an appropriate direction to the respondents to complete the Demarcation proceeding in a time bound manner. 10.3. Any other relief which this Hon'ble Court may deem fit and proper in the facts of the case.” 2) Mr. Singh would submit that the Petitioners, who are brothers and joint owners of land admeasuring 0.043 hectare (4628 sq.ft.) bearing Survey No. 678/5, Patwari Halka No. 40, Mauja Tifra, Bilaspur, had submitted an application for demarcation (Seemankan) on 27.10.2020 before Respondent No. 4. Respondents No. 4 and 5 accordingly requested Respondent No. 3 to constitute a team for carrying out the demarcation. However, despite repeated requests, Respondent No. 3 has failed to constitute the said team. He would further submit that the Patwari of the concerned Halka has already sent a memo to the Tehsildar requesting the constitution of a team for the said purpose, but no action has been taken till date. He, therefore, prays for issuance of a direction to the concerned Tehsildar to take appropriate steps in the matter. 3) Taking into consideration the fact that the application filed by the Petitioners for demarcation is pending consideration since 27.10.2020, and despite the memo issued by the Patwari, the demarcation team has not yet been constituted, this petition is disposed of at this stage with a direction to the Tehsildar to take appropriate steps for carrying out the demarcation of Survey No. 678/5 at the earliest, preferably within a period of 120 days from the date of receipt of a copy -3- of this order. 4) With the aforesaid observation and direction, this petition is hereby disposed of at the admission stage itself.
