GP MUNCIPAL ADMN AND URBAN DEV AP The Court made the following: 2 THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION NO: 15423/2025 ORDER: The present Writ Petition is filed to declare the action of the Respondent Nos. 5 and 6 in attempting to dispossess the Petitioner from Plot No.1 in Sy.No.626 of Dharmavaram Village, Dharmavaram Mandal, Sri Satya Sai District without any prior notice as illegal and arbitrary. 2. Learned counsel for the Petitioner contends that the Petitioner had purchased the subject property through registered Sale Deed dated 13.01.2023 vide Document No.8785 of 2023 and since then he has been in possession and enjoyment of the subject property and that the vendor of the Petitioner was assigned the house plot vide Assignment Patta No.58/419, dated 12.03.2010. He further submits that Respondent Nos. 5 and 6 are threatening to dispossess the Petitioner from the schedule property. Hence, the present Writ Petition is filed. 3. Learned Standing Counsel appearing for Respondent No.5 passed on the signed instructions of the Commissioner, Dharmavaram Municipality, wherein it is mentioned that no action has been taken by the 3 Respondent No.5 to dispossess the Petitioner from the schedule property. The relevant portion of the Written Instructions reads as under: “ It is further submitted that this Respondent i.e., the Dharmavaram Municipality represented by its Commissioner has not taken any action to dispossess the Petitioner nor has it issue any notice to the Petitioner with respect to the subject property”. 4. Learned Assistant Government Pleader appearing on behalf of Respondent No.6 on instructions submits that no steps are being taken by the Respondent No.6 to dispossess the Petitioner. 5. In view of the submissions made by the Respondent Nos. 5 and 6 and taking note of the written instructions passed on to the Court, as extracted above, the grievance of the Petitioner is redressed. 6. Accordingly, the Writ Petition is closed. There shall be no order as to costs. As a sequel, miscellaneous applications pending, if any, shall stand closed. ________________ NYAPATHY VIJAY, J.
