The petitioners, 1) Pankaj Gogoi, and 2) Ashim Hazarika, have filed this application under Section 482 of the BNSS, 2023, with prayer for pre-arrest bail as they are apprehending arrest in connection with Naharkatiya PS Case No. 82/2024, registered under Section 308(4) of the BNS, 2023. 3. The allegation against the petitioners is that they are involved in extorting money from the local public of Nahorkatiya. 4. The petitioners were granted interim bail by a coordinate Bench of this Court. The petitioners have appeared before the IO. 5. I have also scrutinized the Case Diary. 6. I have considered the submissions at the Bar with circumspection. 7. It appears that custodial interrogation of the petitioners may not be required. Thereby, interim order dated 16.12.2024, is hereby made absolute, under the conditions that- 1) the petitioners shall appear before the IO on every fortnight, till completion of investigation, 2) the petitioners shall refrain from such activities with which they are alleged, and 3) the petitioners shall not leave the jurisdiction of the Court, without prior permission.
