Roy, the learned CGC appearing on behalf of the Union of India. I have also heard Mr. P. Bharadwaj, the learned Standing counsel appearing on behalf of the Indian Oil Corporation Ltd., 2. The Petitioners herein have filed the instant writ petition challenging the technical qualification of the private Respondent No.11 in the Technical Bid meeting dated 31.01.2024 with regard to transportation of Page No.# 5/5 Indane LPG Cylinders in vertical position on unit rate basis, ex- Bongaigaon Bottling Plant of e-Tender vide IOAODSO/PT/PACKED/7B10/23-24 as mentioned at Serial No.19 of the Tender Summary Reports dated 25.02.2024 issued by the Indian Oil Corporation. 3. Mr. P. Bharadwaj, the learned Standing counsel appearing on behalf of the Indian Oil Corporation Ltd. submitted that pursuant to the representation so submitted by the Petitioners, enquiry was conducted and it was found that the allegation so made in the representation had merits and in pursuance thereto, the Indian Oil Corporation Ltd. had also issued a show cause notice to the Respondent No.11 and thereupon had blacklisted the Respondent No.11. In that regard, he has placed before this Court a communication dated 16.12.2024 issued by the Chief General Manager (LPG), Indian Oil AOD State Office to the Respondent No.11 which is kept on record and marked with the letter “X”. 4. The learned counsel appearing on behalf of the Petitioner submits that in view of such decision being taken by the Indian Oil Corporation Ltd., the Petitioners would not like to further proceed with the instant writ petition. 5.
