BEFORE HONOURABLE MR. JUSTICE BUDI HABUNG ORDER Date : 21-04-2025 Heard Ms. M. Saikia, learned counsel for the applicant. This is an application filed under Section 5 of the Limitation Act, 1963 read with proviso to Section 173 of the Motor Vehicles Act, 1988 for condonation of delay of 5 (five) days in filing the connected appeal. The ground for delay in filing the connected appeal has been stated in paragraphs 2 and 3 of the application. On perusal of the ground stated in the above paragraphs, this Court is
Page No.# 3/3 satisfied that the applicant was prevented by sufficient cause in preferring the connected appeal within the stipulated time. Moreover, Mr. A. T. Sarkar, learned counsel for the respondent no. 1 has no objection to the condonation of delay of 5 days in filing the connected appeal. In view of the above, the delay of 5 days in preferring the connected appeal is hereby condoned. With the above, this IA stands allowed and disposed of.
