JUSTICE PRAVEER BHATNAGAR
Order 10/01/2025
1. The instant bail application has been filed under Section 483 B.N.S.S. on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.30/2024 registered at Police Station Cyber, District Kota City for the offence(s) under Section 420 of IPC and Section 66D of IT Act.
2.
Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. The matter is exclusively triable by Magistrate. It is contended that the main allegation of causing fraud and transferring money of the complainant Prateek in the account of the accused-petitioner is against the other co-accused Rohit. It is also contended that the accused-petitioner was not aware that the other co-accused Rohit has linked his bank account with the mobile phone No.82396xxxxx and the said mobile number sim was recovered from co-accused
(2 of 3) [CRLMB-345/2025] Rohit. It is also contended that co-accused Rohit in his disclosure statement, also stated that he has opened various bank accounts and thereafter, linked it with the various mobile numbers and transferred the amount in the account of the accused-petitioner and other co-accused namely Harsraj. It is also contended that similarly placed co-accused Harsraj has already been enlarged on bail by this Court vide order dated 04.12.2024 in S.B. Criminal Misc. Bail Application No.14697/2024 and the case of the accused- petitioner is akin to the case of other co-accused. The accused- petitioner is in custody since 17.12.2024 and trial/investigation of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed.
3. Learned Public Prosecutor vehemently opposes the bail application and contends that the amount of Rs.42 lakhs was siphoned in various bank accounts and the accused-petitioner was actual beneficiary as he has received amount of Rs.32 lakhs in his bank account, therefore, considering the above facts, the bail application of the accused-petitioner deserves to be dismissed.
4. Heard and perused the factual report placed on record.
5. The factual report shows that in this case, the other co- accused Rohit linked mobile No. 82396xxxxx with the bank account of the present accused-petitioner and that was operated by the other co-accused Rohit, he is the main culprit from whom 7 mobile phones, 1 laptop, 1 POS machine, 1 wifi device, 23 ATM cards, 63 Bank kit, 9 stamp papers, 22 Loose cheques and various Aadhar cards were recovered, therefore, considering the above
facts, without further commenting anything on the merits of the
(3 of 3) [CRLMB-345/2025] case, I deem it just and proper to enlarge the accused-petitioner on bail.
6. Accordingly, the bail application under Section 483 B.N.S.S. is allowed and it is ordered that the accused-petitioner- Maninder Singh S/o Shri Gurjat Singh in connection FIR No.30/2024 registered at Police Station Cyber, District Kota City, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
