[2025:RJ-JP:31938] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 7772/2025 Meghraj S/o Amar Chand, Aged About 38 Years, R/o Kaushali, Police Station Soorwal, District Sawai Madhopur. (At Present In District Jail Sawai Madhopur) ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Girish Khandelwal For Respondent(s) : Mr. Shree Ram Dhakar, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 14/08/2025 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 77/2025 registered at Police Station Soorwal, District Sawaimadhopur for the offences under Sections 191(2), 190, 121(1), 132, 125(a), 303(2) and 109(1) of BNS and Section 3 of PDPP Act and Section 4/21 of MMDR Act. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. It is contended that the name of the petitioner is not mentioned in the FIR. The allegation of assaulting the police official is against Matul, who has been named in the FIR. There is no identification parade conducted regarding the presence of the petitioner in assaulting the government officials. The accused-petitioner is in custody [2025:RJ-JP:31938] (2 of 3) [CRLMB-7772/2025] since 28.05.2025 and the trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the bail application and contended that petitioner alongwith the other co- accused assaulted the police officials and caused injuries. The police has registered a case under Section 109(1) of the BNS alongwith other offences. The accused-petitioner is a habitual offender and against him seven criminal cases were registered under various offences, therefore considering the above fact, the bail application of the petitioner deserves to be dismissed. 4. Heard and perused the material available on record. 5. Considering the fact that the injuries sustained to the government official were found to be simple in nature and not dangerous to life. The accused-petitioner is in custody since long and the trial of the case may take considerable time, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Meghraj S/o Amar Chand, in connection with FIR No. 77/2025 registered at Police Station Soorwal, District Sawaimadhopur, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge. 7. The accused is also directed to mark his presence on 25th of every month till conclusion of trial before the concerned police station. The SHO of the concerned police station shall send the [2025:RJ-JP:31938] (3 of 3) [CRLMB-7772/2025] presence report of the accused petitioner on the same day to the trial court every month. In case of any breach to the above condition, the learned Public Prosecutor shall be free to move the application against the petitioner for cancellation of the bail before the concerned Court.
