Applicant seeks regular bail in FIR No. 449/2024 dated 02.10.2024, for commission of offence under Section 64(1) of Bharatiya Nyaya Sanhita (BNS), 2023 (corresponding Section 376 IPC), registered at P.S. Maidan Garhi. 2. The applicant was arrested on 02.10.2024 and after ascertainment of the charges, the case was fixed for prosecution evidence. 3. The concerned prosecutrix has already entered into witness box and has been discharged and, therefore, there is no apprehension of any threat to her. 4. Learned counsel for applicant submits that the applicant is 27 years of age. He is a footballer with no other involvement of any nature whatsoever. There was, though, consensual relationship between them, there was never any rape. He contends that allegation of rape stands belied as FSL report, virtually, exonerates him. 5. Applicant shall not try to contact any public witness, directly or indirectly. ii. He shall not leave the National Capital Territory of Delhi, without prior permission of learned Trial Court. iii. Applicant shall furnish a mobile number to concerned IO on which he can he contacted, if required. Such number shall remain operational and functional. 6. The application stands disposed of in aforesaid terms. 7. A copy of this Order be immediately sent to the learned Trial Court and Jail Superintendent for information and necessary compliance.
