Neutral Citation No. - 2025:AHC:31522-DB Court No. - 29 Case :- WRIT - C No. - 6339 of 2025 Petitioner :- Shramjivi Kisan Producer Company Ltd. And Another Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Praveen Kumar Singh Counsel for Respondent :- C.S.C. Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. Petitioner is aggrieved by a communication issued by the Deputy Director Agriculture, Ghazipur dated 15.10.2024, which records that under the scheme of agriculture department, the amount of subsidy for purchase of instruments would be made available to those who are engaged in the scheme. However, those who have already been provided subsidy for the purpose in the past will be ineligible to apply.
Learned counsel for the petitioner states that under the scheme floated by the Government, there is no provision for excluding those who have already received benefit in the previous years. Learned Standing Counsel opposes the prayer made in the writ petition. The object of the scheme appears to facilitate the purchase of equipment for the scheme itself. Once the applicants have already been granted such benefit in the past, no useful purpose would be served in extending subsidy for the same purpose in the subsequent years. We find no irrationality in decision of Deputy Director, inasmuch as those who have already been granted subsidy for the purchase of equipment need not be repeated such benefit in subsequent years. The order of the Deputy Director Agriculture, Ghazipur, therefore, cannot be said to be arbitrary or illegal. No interference in the writ petition consequently is called for and the same is dismissed.
