1. The applicants have preferred this second bail application under Section 483 of Bhartiya Nagarik Suraksha Sanhita 2023 for grant of regular bail as they have been arrested on 16.03.2024 in connection with Crime No. 6 of 2024 registered at Police Station – Taregaon Jungle, District Kabirdham, (CG) for alleged commission of offences under Sections 302, 201/34, 120-B, 147 & 148 of IPC. First bail application of the applicants were dismissed on merit vide order dated 05.09.2024 in MCRC No. 5510 of 2024 and MCRC No. 5710 of 2024. Learned counsel for the applicants would submit that the applicants are in jail since 16.03.2024, out of 27 witnesses only 13 witnesses have been examined so far and now the matter is fixed for further evidence. He would further submit that he seeks permission of this Court to withdraw this bail petition with a prayer that a direction may be given to the trial court to expedite the trial.

Considering the fact that out of 27 witnesses, 13 witnesses have already been examined and remaining 14 witnesses have to be examined, further considering the fact that the applicants are in jail since 16.03.2024 and also further considering that this Court has already directed the learned trial Court to conclude the trial within an outer limit of 1 year and three months from 27.03.2025 in MCRC No. 9085 of 2024, no further direction is required for.
4. With the aforesaid observation, the instant MCRC is dismissed as withdrawn.
