1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.34/2025 registered at Police Station – Raghunathpur, District-Surguja (C.G.) for the offences punishable under Sections 420, 467, 468, 471 of Indian Penal Code.
2. Case of the prosecution, in brief, is that an FIR has been lodged by the Tahsildar Raghunathpur in compliance of order dated VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2025.05.13 12:25:00 +0530
2 30.01.2025 passed by Collector Surguja in Revenue Case No. 25/B-121/2024-25 whereby it has been alleged that in the year 2010 the applicant has got his name mutated in the revenue records of Khasra No. 48/2 Rakba 0.210 Hectare of land belonging to Scheduled Tribe person on the basis of a forged
order dated 26.11.2010 passed by Board of Revenue.

Learned counsel for the applicant submits that the applicant is innocent and he has been falsely implicated in the present case. He would submit that the Collector Ambikapur has ordered to register FIR in name of several persons wherein the name of Dastgir against whom allegation of preparing forged order of Board of Revenue has been leveled bearing Crime No. 595/2024, 659/2024, 658/2024, 221/2025 registered at Police Station Ambikapur and the land owners have been granted benefit of Anticipatory bail in identical cases having different Crime Numbers in MCRCA No. 553 of 2025, MCRCA No. 614 of 2025, investigation and trial are likely to take time, therefore, he submits that the present applicant is entitled to be released on anticipatory bail. 4. On the other hand, learned State counsel opposes the prayer for grant of anticipatory bail and submits that applicant has no previous criminal antecedent. 5. I have heard learned counsel for the parties and perused the case diary. 3

Considering the facts & circumstances of the case, gravity of offence, nature of dispute and material available on record and further that the applicant has no previous criminal antecedent, and land owners have been granted benefit of Anticipatory bail in identical cases having different Crime Numbers in MCRCA No. 553 of 2025, MCRCA No. 614 of 2025, investigation and trial are likely to take time, therefore, I am inclined to grant anticipatory bail to the present applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Salim Javed on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.
(d) The applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size
4 photo having printed the adhaar number on it, which shall be verified by the trial Court. (e) The applicant shall not involve himself in any offence of similar nature in future. Sd/- (Ramesh Sinha)
