GP FOR HOME (AP) The Court made the following: 3 THE HONOURABLE SRI JUSTICE B.V.L.N.CHAKRAVARTHI WRIT PETITION No.14314 OF 2019 ORDER: This Writ Petition is filed under Article 226 of the Constitution of India for the following relief: “….to issue a writ of mandamus or any other appropriate writ or direction declaring the action of the 3rd respondent in repeatedly calling the petitioners to the police station and trying to arrest the petitioners as illegal, arbitrary and violation of Art.21 of constitution of India and consequently direct the respondents not to take any coercive steps including arrest of the petitioners without following the procedure contemplated under Sec. 41A of Cr.P.C…” 2. Heard Sri C.Subodh, learned counsel for the writ petitioners and learned Assistant Government Pleader for Home. 3. Learned Assistant Government Pleader for Home would submit that on earlier occasion, police will not call the petitioners to the Police Station without following due procedure established law, and no further orders are required in the writ petition, and it may be closed. Learned counsel for writ petitioners would submit that in the light of submissions made by the learned Assistant Government Pleader for Home, no further orders are required in the writ petition at this length of time, and the writ petition may be closed. 4. Considering the submissions made by the learned counsel for the writ petitioners, and in view of the earlier submissions made by the learned Assistant Government Pleader for Home, this Court of the considered opinion that the writ petition can be closed, without going into merits of the case. 4 5. Accordingly, the Writ Petition is closed. There shall be no order as to costs.
