Ramachandra Murthy, learned counsel for petitioner and learned Assistant Government Pleader for Services-I for respondents. 3. Petitioner, while working as Commercial Tax Officer (CTO) has been issued charge memo vide G.O.Rt.No.857 Revenue (Vigilance-ll) Department dated 06.08.2016 alleging that he committed certain irregularities in granting refund of tax causing loss to the exchequer, which necessitated in initiating disciplinary r 4 proceedings. Petitioner submitted statement of defence refuting the aforesaid charge and enquiry is stated to be pending. Petitioner is promotion to the post of Joint Commissioner (ST), account of pendency of departmental proceedings, his case is not being considered. now due for however, on counsel for the petitioner submits that the Government has provided timeline for concluding departmental enquiries specifically three months in case of simple cases and six months in case of complex cases in terms of G.O.Ms.No.679 dated 01.11.2009 read with G.O.Ms.No.91 General Administration (SER.C) Department dated 12.09.2022 rather respondents were not adhering the aforesaid timelines in concluding the enquiry petitioner cannot be denied his right to be considered for promotion. Even otherwise, petitioner is entitled to be considered for promotion G.O.I\/ls.No.257 General Administration (Ser.C) 4.
